He has over 20 years of experience in legal practice. He brings vast experience and strong communication skills having acquired such skills in many years of drafting legislation for national Parliament, providing legal advice senior government officials of the various Departments, State Owned Enterprises and for members of Parliament. He also drafted legal advice for many State Owned Enterprises including Public Investment Corporation (PIC), Sentech and others.
His areas of practice are drafting of various legislation in South Africa and provision of legal advice; for instance the Unemployment Insurance Amendment Act, Broadband Infraco Act, 2007, South African Languages Act, 2014 Military discipline Bill and many other legislations. He participated in drafting of the extension of agreement in respect of the Lesotho Highlands Water Project in 2013 between the Republic of South Africa and Lesotho. He gave legal advice to State Owned Enterprises or Public Entities that are involved in construction and supply chain management in respect of GCC, FIDIC and NEC commercial contracts. He drafted legal advice in respect of FIDIC, examining the roles of Employer and Engineer so as to highlight the essential differences under FIDIC contracts and the issue of notices, claims and timebars.
BProc and LLB
In 2000 up until December 2001, Malusi was employed as a Public Prosecutor at Mitchells Plain Magistrate Court in Cape Town. In 2002 up until March 2004, he was employed at Mfazi Kose Attorneys in Cape Town as an Associate Attorney. His main functions were to do litigation in the Magistrate’s Court and High Court, draft court pleadings, drafting of commercial contracts and assist in conveyancing and notarial work. In April 2004, he was appointed as a Senior State Attorney in the unit called the Constitutional Litigation Unit (CLU).
In 2006, he was employed as a Senior State Law Advisor at the Office of the Chief State Law Advisor within the Department of Justice and Constitutional Development. The mandate of this office, amongst others, is to draft the Bills that must be enacted by the national Parliament of the Republic of South Africa, draft legal opinions for national Cabinet, give legal opinions in respect of commercial agreements or contracts that are to be entered into by the Government, Public Entities and State Owned Enterprises with other Parties; International Agreements to be entered into by the Republic of South Africa and other foreign countries.
